    Tribe Hopes Amended Law Will Aid in Land Trust Issue

    In 1934 the Indian Reorganization Act was recognized. It was also known as the Wheeler-Howard Act.  In this act, certain rights of Native Americans are secured.  Mainly it provided them with the right to “manage their assets, which are mainly land, and included provisions intended to create a sound economic foundation for the inhabitants of Indian reservations.”  The act did not require tribes to write up a formal constitution throughout management of their settlements, but if they did, the constitution had to include:

    • Allot for legal counsel for each tribe leading body
    • Prohibit the leading body from engaging any land transitions without majority tribal approval
    • Authorize the leading body to negotiate with local, State and Federal governments

    Much of the questionable coverages of the act were centered on land, in terms of its ownership and governance. This 1934 act is now possibly up for amendment at the leadership of Senator Byron Dorgan, of North Dakota.  Dorgan is calling for an amendment that would confirm the Interior Secretary’s right to enter land into trust for all tribes, apart from when the tribes were established. The original act was a setback for all tribes because it limited their usages of trusts to hold private property for future use.

    One tribe that would directly benefit from the amendment to the 1934 Indian Reorganization Act is the Mashpee Wampanoag tribe. The tribe was trying to put some land into a trust for a casino to be located in Middleboro. Cedric Cromwell, chairman for the Mashpee Wampanoag tribe, stated, “We’re very encouraged by the amendment introduced today by Senator Dorgan, and we are hopeful that Congress will take this opportunity to resolve the inequitable situation caused by Carcieri vs. Salaza.”  Carcieri vs. Salaza was the case that initially limited the government’s power to hold land in trust.  

    Dorgan added that “Inaction by Congress could significantly impact planned development projects on Indian trust lands, resulting in a loss of jobs in an already challenging economic environment; and create costly and unnecessary litigation.” The tribal communities are hoping the new amendment makes it legal to move land into trust for future expansion and development.
